A fee is a form of payment to a law company for legal services provided to a Client. It is stipulated by a legal services agreement. A fee may be transferred or paid on a bank account of a law company.

The following factors may be considered in order to determine the amount of a fee for legal services provided:

• Timeframe and scope of work required for the proper rendering of legal services;
• complexity and novelty of legal matters relating to the legal services provided;
• probability of the fact that the provision of legal services will impede or significantly complicate the provision of other services by the Law Company within a usual timeframe;
• the necessity of business trips;
• the achievement of positive results set by a client as an effect of legal services provided;
• special or extra requirements of a client regarding the timeframe of legal services provision;
• nature and duration or professional relations between a Law Company and a Clint;
• the need of outsourcing experts for solving specific problems arising in the course of legal services provision;
• reputation of a Law Company and/or its partners; etc.

The following payment systems are used by AMIDA Law Company:

• fixed - the cost of legal services remains unchangeable during the provision of legal assistance and is determined by concluding one-time agreements on provision of a fixed scope of legal services including pleading in courts, turnkey company incorporation, etc. (the price is subject to negotiation);
• hourly - the cost of legal services depends on the time spent by a Law Company representative and is calculated on the hourly basis which is determined by long-term agreements on rendering legal services as the client applies. The payment for actually rendered services is calculated on the basis of one-hour cost according to the price-list;
• monthly - provides for the unlimited scope of legal services rendered at discount price (10%, 15% or 20%) which is determined by long-term agreements on comprehensive legal support for the fixed monthly payment (pleading in courts is paid extra).

The Law Company starts rendering legal services immediately following the prepayment receipt from a client. The amount of prepayment depends on the total cost of legal services:

Extra costs associated with legal services (such as state dues, court fees, notary services, expert services, etc.) are not included in the cost of legal services.

AMIDA Law Company renders legal services to natural persons and legal entities on the basis of monthly payment system starting from UAH 1,500.00. Pleading in courts is paid extra and is subject to negotiations (5-10% of suit amount); however fixed and hourly payment is also acceptable.

In case of performing certain complicated tasks and/or tasks requiring one-time considerable time effort, an additional fee of the Law Company may be stipulated by the Agreement. The classification of tasks and disputes into complicated and those requiring considerable time effort is subject to mutual agreement of the parties (e.g. pleading in courts in case of a complicated dispute etc.).

Besides rendering legal services on the basis of monthly payment system, the Law Company offers to Clients the two following payment systems:

• Hourly payment;
• Fixed payment (including phased fixed payment and fixed pay-for-performance).

Hourly payment

Hourly payment is a form of payment for legal services provided which is calculated subject to the time spent by the Law Company employees on rendering legal services to a Client. It is based on the hourly rate depending on the position, qualification level, and work experience and is paid by a Client against the invoices that may be submitted by the Law Company on the weekly, monthly or phase basis.

The time to be paid for includes all time spent on rendering legal services to a Client and namely:

• meetings with a Client;
• meetings and negotiations with other persons regarding the Client’s case;
• preparation of documents;
• preparation of and familiarization with letters, facsimile and e-mail correspondence;
• participation in sittings of the court;
• visiting institutions which may be associated, involved and have some influence or otherwise be connected with rendering legal services to a Client, or visiting other institutions for the purpose of Client’s case;
• juridical search in laws, court practice;
• other juridical activities in any other time spent rendering legal services to a Client.

Where a few employees of the Law Company are involved in any aspect of the case (e.g. two or more employees participated in meetings, sittings of the court, and problem discussions) the time spent by each employee is paid for separately.

At that, the time spent by the Law Company employee pending and traveling within Lviv shall be paid for in the amount of 50% of the standard hourly rate.

The hourly rate of the Law Company employees varies from UAH 250 to UAH 700.

The time spent by the Law Company employees on business trips while rendering legal services is paid for by a Client based on regular working hours (as usual 8 hours).

The hourly method of payment enables Clients to control costs and time spent on services provision.

Fixed payment

Fixed payment is a form of payment for legal services which is determined by agreement with a Client and is paid one time.

It enables Clients to plan their expenditure on payment for legal services.

The possibility of fixed payment change (increase, reduction) may be stipulated by the agreement. A new form of payment for legal services may be applied in view of considerable increase or reduction of the scope of legal services that are being rendered or to be rendered.

Phased fixed payment

Phased fixed payment is a form of payment for legal services rendered to a Client which is determined by verbal agreement with a Client and is paid on the weekly, monthly, quarterly, phase basis etc.

It enables Clients to plan their expenditure on payment for legal services.

The possibility of phased fixed payment change (increase, reduction) may be stipulated by the agreement. A new form of payment for legal services may be applied in view of considerable increase or reduction of the scope of legal services that are being rendered or to be rendered.

Pay-for-performance

Pay-for-performance is a total payment for the services rendered by the Law Company regardless of the chosen tariff and form of payment for legal services provided by the Law Company.

It is a payment for the services actually rendered by the Law Company to a Client which is determined where the Company deals with the case connected with protection (preservation for a Client) of funds (assets) of Client’s funds (property) from exaction on demand of State Tax Authorities of Ukraine – a percent share in pecuniary valuation of such claims.

Actual costs connected with the provision of legal services to Clients

Besides the fee, Clients shall cover actual expenses arising in the course of provision of legal services.

The following types of anticipated actual expenses connected with the provision of legal services to Clients are taken into consideration:

• Business trip expenses;
• payments for the services of outsourced experts for solution of specific problems arising in the course of legal services provision to a Client;
• transport charges;
• printing, copying and other technical works costs;
• documents translation and notarization costs;
• payment for telephone calls (including international ones);
• payment for facsimiles;
• courier services costs;
• state dues payment;
• representation expenses;
• other expenses connected with the provision of legal services to a Client.

Clients can be offered a discount depending on their kinds of activity, type and scope of works etc.
